Congress Bought You Until December. USCIS Didn't Wait.

Congress bought the country until December 11 — no October shutdown, no interruption to the permits, reservations, and visitor centers your season depends on. USCIS didn't wait for anyone: the H-2B cap for winter-season workers closed nine days ago, and the filing pace says next year's summer cap will close faster too.

The Continuing Appropriations and Extensions Act, 2027 was signed into law September 2, keeping the federal government funded through December 11 and averting a shutdown that would have hit right at the start of the federal fiscal year — exactly when fall shoulder season is in full swing and hunting-season permits are moving. For operators who lease from, permit through, or simply depend on visitor access to national parks, national forests, and BLM land, that's the headline: no interruption to camping reservations, backcountry permits, or visitor center hours between now and the holidays.

The fight isn't over, it's rescheduled. December 11 lands squarely in holiday travel season, which means the next shutdown cliff arrives at one of the worst possible times for any business that depends on public land staying open and staffed. If your winter operations touch federal land in any way — permits, concessions, adjacent bookings — put December 11 on your calendar now, not in late November when Congress starts negotiating again.

USCIS closed the H-2B cap for the first half of fiscal year 2027 on September 4, then announced it September 12. The annual program is split into two 33,000-visa halves: October 1–March 31, and April 1–September 30. The first half is now full. If you were counting on H-2B workers for a winter operation, that door is shut until the second-half window opens, and USCIS hasn't yet said whether supplemental visas will be released this cycle. Near-term options are H-2A, another visa category if you qualify, or covering the gap domestically.

The bigger signal is for anyone staffing next summer. Immigration attorneys tracking the program report this cycle's cap closed faster than last year's did. If your season runs April through September, the same crunch is coming for the visas you'll need next — and waiting until spring to file is how you end up short-staffed in June. Get your petition paperwork, job orders, and temporary labor certification ready now so you can file the day the second-half window opens, not after you notice everyone else already has. If you've never used H-2B and are staring down another summer of chronic no-shows, this is worth a real look before next year's hiring season, not a last-minute scramble in March.

The BLM opened McCoy Flats Campground outside Vernal, Utah on September 1 — 23 sites, 20 of them mixed-use for RVs, vans, and tents, plus three walk-in ADA-accessible sites, built specifically to serve the McCoy Flats mountain bike trail system and the Josie Mosie OHV trail. Planning and environmental review ran through 2024, design finished summer 2025, and construction carried through fall 2025 into summer 2026 — a two-year runway that was locked in well before this month's funding fight, which is exactly why it opened on schedule regardless of what Congress was doing in Washington.

It's a small project, but it's new public-land camping capacity landing in the middle of a budget standoff, not despite one. If you run a private park, guide service, or rental operation near a BLM or Forest Service trail system, a new federal campground nearby is worth tracking: it usually brings more trailhead traffic than the new capacity can absorb, and overflow guests are exactly what private operators are built to catch.
